JOB TITLE: COMMERCIAL DIRECTOR

 

KEY RESPONSIBILITIES:

  • It is accountable to ensure all commercial activities are in line with the corporate delegation of authority matrix, risk review committee requirements, and contracting protocol requirements.

  • Ensure all commercial activity is performed in a professional and ethical manner in full compliance with the company’s values, processes, and code of conduct.

  • Lead in the recruitment, mentoring, guidance, and training of commercial, contract, and supply chain teams with appropriate function input as required.

  • Carry out annual and mid-year reviews with direct reports in line with the company HR process and support the talent management program.

  • Provide and promote a strong culture of client management and focus to ensure that client requirements and objectives are fully understood and delivered to a high standard. 

  • Ensure compliance with company- and project-specific procedures that relate to contractual, commercial, procurement, and project service requirements.

  • Working with Business Development, Legal, and other corporate and functional groups to develop the execution strategy and lead and manage the commercial and contract input into tenders aligned to the win strategy.

  • Ensure that the company’s liabilities and legal/contractual obligations are defined, communicated, and qualifications are correctly incorporated into the tender response.

  • Ensuring that, where appropriate, client and partner due diligence is undertaken.

  • Ensure that all commercial, contractual, and structural risks are identified, communicated to operational teams through commercial / project services, and followed up on to ensure the mitigation and management of risks involved in contract delivery.

  • Identify and manage the obligations in the client contracts that are either obligatory flow-downs or those that provide a benefit or protection, including across all supply chain activities across the applicable service lines.

  • Ensure concerns provided by the Compliance, Tax, and Legal departments particular to working in new territories / locations or with new clients are properly addressed and managed, including agreed-upon strategies to mitigate them.

  • Manage and lead the commercial and contractual participation for Asset Solutions RRC and Group RRC approval meetings to ensure compliance with corporate governance and present all commercial and contractual aspects of our bid for approval.

  • Lead in the negotiation of contracts for award and ensure a review of the contract’s acceptability prior to execution and that a comprehensive summary of the critical aspects of the contract is communicated and handed over for handover to the execution team.

  • Lead in areas of risk and opportunity identification and ensure a suitable project risk mitigation plan is in place where applicable.

  • Manage the monitoring and reporting of the monthly commercial reports on contract P&L, debtors, SACs, and CAC’s in coordination with finance and take action where required to mitigate exposure, including leading corrective action with service line managers to address any issues.

  • Analyze the overall commercial performance of contracts with service line managers, identify opportunities for cost reduction, efficiency, and/or profit growth, and ensure the adoption of commercial best practices.

  • Implement a set of metrics against which this performance can be benchmarked across the business.

  • Lead and manage teams as required to be the point of contact on all contractual matters between the service line and clients, ensuring timely submission, review, and approval/reconciliation of variations and formal correspondence between Petrofac and the client.

  • Ensure commercial and project control structure are in place and deliver to support operational teams in contract management areas such as contract change control and claims management, including timely Client notification, assistance in preparation of the change order request, client follow-up and negotiation, and review and approval of Client change orders.

  • Ensure, immediately post-award, that all key personnel are communicated to and are aware of all relevant commercial and contract execution information by conducting Contract Awareness Training as applicable.

  • Lead in key meetings with clients in which decisions and agreements may have a contractual and/or commercial impact and ensure that all operational delivery teams are fully supported through the commercial and/or project services teams in client meetings where contractual and commercial discussions occur.

  • Management of the supply chain team includes training, issue management, and interface management between the team and other functions.

  • Ensure all procurement activities are undertaken in line with all Company policies and procedures to meet the project requirements.

  • Ensure subcontractor due diligence is undertaken.

  • Ensure across all contracts that Subcontracts have suitable flow-down provisions.

  • Accountable for effective management of all subcontractors with support of functional and technical teams as appropriate

 

Essential Qualifications and Skills:

  • Degree-qualified, preferably in Quantity Surveying / Law.

  • Extensive commercial managerial experience with commercial proposals and commercial management in an Oil and Gas Services company.

  • Power user of Microsoft Office software.

  • strong leadership drive, with the ability to manage multiple commercial challenges.

  • A high degree of flexibility, effective self-management, and excellent communication skills.

  • a proven track record of managing multiple stakeholders in project execution.

  • Demonstrated ability to manage and develop people, motivate and develop current and new people, and build high-performing teams.

  • Proven client interaction and negotiation skills.
